These Terms of Service ("Terms") explain the terms and conditions on which TestShift Ltd provides access to the TestShift app, website, driving test cancellation monitoring service, notification service, manual test acceptance features, and any related services we provide.
Please read these Terms carefully before using TestShift. By creating an account, purchasing a premium account, entering your driving test details, enabling notifications, manually accepting a test through TestShift, or otherwise using TestShift, you agree to these Terms.
If you do not agree to these Terms, you must not use TestShift.

TestShift Ltd is not affiliated with, endorsed by, approved by, sponsored by, or authorised by the Driver and Vehicle Standards Agency ("DVSA"), GOV.UK, or any government department.
TestShift is a third-party driving test cancellation monitoring and notification service.
Depending on the features available to you and the settings you choose, TestShift may:
TestShift does not guarantee that you will find an earlier driving test date, that you will receive every possible cancellation notification, that a test will still be available when you act on a notification, or that any manual attempt to accept a change to a test through TestShift will be successful.
TestShift may allow you to manually attempt to accept a change to a driving test shown in the app.
This is a manual, user-initiated feature. TestShift does not automatically accept, change, swap or cancel driving tests for you without your active instruction.
A test change will only be attempted through TestShift if you choose to act on a notification or available test shown in the app and manually confirm that you want to proceed.
By manually choosing to accept a change to a test through TestShift, you authorise TestShift to use the details you have provided to attempt to carry out that action on the DVSA booking service on your behalf.
Before manually accepting a change to a test through TestShift, you are responsible for checking that:
If you manually accept a change to a test through TestShift, your existing DVSA test booking may be changed. You are responsible for checking the official DVSA booking service after taking any action through TestShift.
We are not responsible if you manually accept a change to a test that you later cannot attend, that your instructor cannot attend, that is at the wrong centre, that is at an unsuitable time, or that is non-refundable under DVSA rules.
TestShift is not an official DVSA service.
The official driving test booking service is operated by DVSA. Your driving test booking, your access to the DVSA booking service, and your ability to change, swap, cancel or manage a test are controlled by DVSA and are subject to DVSA's own terms, policies, rules, systems and enforcement decisions.
By using TestShift, you acknowledge and accept that DVSA has stated that learners should not use unofficial apps, websites or services that search, scan, change, swap or cancel driving tests on their behalf.

You choose to use TestShift at your own risk. TestShift cannot control DVSA's systems, rules, policies, decisions, restrictions, enforcement actions, availability, technical issues, booking limits or cancellation decisions.
To the fullest extent permitted by law, TestShift Ltd is not responsible for any loss, cost, inconvenience, missed test, cancelled test, changed test, restricted DVSA access, inability to manage a booking online, additional DVSA fee, lost driving lesson, instructor charge, vehicle hire cost, travel cost, or other loss arising from any action, decision, restriction, cancellation, policy change, system change, enforcement action, or other act or omission by DVSA.
Nothing in these Terms excludes or limits any rights or protections that cannot legally be excluded or limited.
To use TestShift, you may need to provide information such as your:
By providing this information, you authorise TestShift to use it for the purpose of providing the service, including accessing, checking, searching, monitoring and, where you manually instruct us to do so, attempting to accept a change to a driving test through the DVSA booking service using the details you provide.
You confirm that the information you provide is accurate, belongs to you, and that you are the learner driver connected to the driving licence number used on the account.
You must not use TestShift to search for, monitor, accept or change driving tests for someone else.
The accurate and official date, time, location and status of your driving test booking is the information shown directly by DVSA.
The date, time, location or status shown in the TestShift app may be delayed, incomplete, inaccurate or out of date. This can happen because of DVSA system changes, caching, technical issues, sync delays, user settings, network issues, or other factors outside our control.
You are responsible for checking the official DVSA booking service directly to confirm your current test details.
We are not responsible for any loss, missed test, cancellation, inconvenience, cost or other issue caused by you relying only on the information displayed inside TestShift rather than confirming your booking directly with DVSA.
If you use our premium service, we will attempt to monitor for earlier test availability based on your selected preferences and send notifications when we identify possible availability.
We do not guarantee that:
A notification means only that TestShift identified possible availability at or around the time the notification was generated. It does not mean the test is reserved for you, held for you, guaranteed for you, or still available.
You are responsible for acting on notifications yourself and for checking DVSA directly before making any decision.
DVSA may change, restrict, suspend or cancel your driving test booking for reasons outside our control.
This may include, but is not limited to:
To the fullest extent permitted by law, we are not responsible for any cancellation, change, restriction, suspension, missed test, lost test fee, additional cost, or other loss caused by DVSA or by circumstances outside our reasonable control.
You are responsible for:
The responsibility for attending the driving test, using a suitable vehicle, bringing the correct documents and being ready to take the test lies with the learner driver.
Each TestShift account may only be used for the learner driver connected to the driving licence number entered on the account.
You must not:
We may suspend or terminate your account if we reasonably believe you have breached these Terms, misused the service, created risk for us or other users, or used the service in a way that is not permitted.
Where reasonable, we will try to contact you before suspending or terminating your account, but we may act immediately where we believe there is a legal, security, operational, fraud, abuse or compliance risk.
A premium account gives you access to TestShift's paid features, which may include monitoring, cancellation alerts, selected notification features, manual test change acceptance features, and other features made available in the app.
Unless otherwise stated at the time of purchase, a premium account is linked to one learner driver and can be used until that learner passes their practical driving test.
We may change, remove, suspend or limit features where necessary because of technical, operational, legal, compliance, DVSA-related or platform-related reasons.
Purchasing a premium account does not guarantee that you will change to, or attend an earlier test.
Payments made through testshift.co.uk and testshift.app are sold and processed by Paddle, acting as the Merchant of Record and authorised reseller for those purchases.
Purchases made through Paddle are also subject to Paddle's Buyer Terms and Paddle's Refund Policy.
You may be able to manage your payment or request a refund through Paddle.
Nothing in these Terms limits Paddle's Buyer Terms, Paddle's Refund Policy, or your statutory rights.
You may have the right to cancel your purchase and request a refund within 14 days, in line with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the refund policy of the payment provider used for your purchase.
If you ask us to begin providing the service during the 14-day cancellation period, including by asking us to start searching, monitoring, sending notifications, enabling premium features or allowing you to manually accept tests changes through TestShift straight away, you acknowledge that the service will begin immediately.
Where the service has already started, you may lose the right to a full refund to the extent the service has already been supplied.
Where the service has been fully performed, you may lose the right to cancel, where this is permitted by law and where the required consent and acknowledgement have been provided.
This does not affect any other statutory rights you may have.
We aim to keep TestShift available and working properly, but we do not guarantee uninterrupted, error-free or continuous access.
TestShift may be unavailable, delayed, limited or interrupted because of:
We may update, change, suspend, withdraw or discontinue parts of the service at any time.
TestShift is provided on an "as is" and "as available" basis.
We do not guarantee that:
Nothing in this section affects your statutory rights.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Where we are legally responsible to you, our liability will be limited to losses that were a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We use this information to provide the service, support users, investigate issues, maintain service records, prevent misuse, improve the service, and comply with legal, regulatory, tax, accounting and platform obligations.

All intellectual property rights in TestShift, including the app, website, branding, design, software, text, graphics, logos, features, systems and underlying technology, belong to TestShift Ltd or our licensors.
You are granted a limited, personal, non-transferable, non-exclusive right to use TestShift for your own personal driving test search purposes, subject to these Terms.
You must not copy, reproduce, modify, distribute, sell, rent, reverse engineer, scrape, decompile or create derivative works from any part of TestShift unless permitted by law or expressly agreed by us in writing.
We may update these Terms from time to time.
If we make changes, we will post the updated Terms on our website or in the app. The updated Terms will apply from the date shown at the top of the document, unless stated otherwise.
You are responsible for reviewing these Terms regularly.
If you continue using TestShift after the Terms are updated, you will be treated as having accepted the updated Terms.
If you do not agree to the updated Terms, you must stop using TestShift.
You can stop using TestShift at any time.
Deleting the app from your device may not automatically cancel your premium access, payment, account or search activity. You should follow the relevant in-app, Paddle or website process to manage your account or purchase.

We will aim to review and respond to support requests within a reasonable time.
These Terms are governed by the laws of England and Wales.
If you are a consumer living in the United Kingdom, you may bring legal proceedings in the courts of the part of the United Kingdom where you live.
Nothing in these Terms affects any mandatory consumer rights you have under the law of the country or region where you live.
If any part of these Terms is found to be invalid, unlawful or unenforceable, the rest of the Terms will continue to apply.
If we do not enforce a right under these Terms immediately, this does not mean we have given up that right.
You may not transfer your rights or obligations under these Terms to another person without our written permission.
We may transfer our rights and obligations under these Terms where this does not materially reduce your rights as a consumer.
These Terms form the agreement between you and TestShift Ltd for your use of TestShift.
