These terms of service for TestShift Ltd. ('we', 'us', or 'our') outlines the terms and conditions on which we provide our services, access to our website, and any other services we provide to you. By using our services, you agree to be bound by these terms and conditions.
These terms and conditions are subject to change at any time, and we will notify you of any changes by posting an updated version of these terms and conditions on our website. You are responsible for regularly reviewing these terms and conditions. Continued use of our services after any such changes shall constitute your consent to such changes.
All software and services, including the TestShift app and notifications service, are provided by TestShift Ltd (the company) on an 'as is' and 'as available' basis with no warranties of any kind. This does not affect your statutory rights.
By using the TestShift app and providing us with your driving licence number and theory pass number or test reference number, you consent to us logging into the DVSA website using your provided login details to check for driving test cancellations and new available tests. You also recognise that TestShift Ltd has no affiliation with the Driver and Vehicle Standards Agency (DVSA). Subscribing to this service does not guarantee finding an earlier test date.
The accurate date of your driving test booking is the one displayed on the DVSA website. The date shown in the app may be incorrect in some cases, and we do not accept responsibility for any inaccuracies in the app.
When using our premium service, we will monitor the DVSA website for you and send notifications once we find an earlier test at your chosen test center(s). We cannot guarantee that you will receive notifications for every test cancellation or every test we locate.
When we send you a notification with an earlier test, it means we have identified one for you. We do not guarantee that the test will still be available by the time you respond to the notification.
We cannot be held responsible for the DVSA changing the date and/or time of your test, or for them cancelling the test due to driving examiner illness, or due to weather conditions, such as snow, ice or fog.
If you enable auto booking or book a test date through app manually then it is your responsibility to cancel it, if needed.
We cannot take responsibility if the user books a non-refundable test through us and then decide to cancel. We can also not take any responsibility for booking non-refundable dates through our auto book service.
Our premium (paid) account grants you access to our automated notifications service and automatic booking service. You can use a premium account on one device and keep using it until you pass your driving test.
The responsibility for attending the driving test, ensuring you have the correct documents, and using a suitable vehicle lies with the learner driver. We cannot be held accountable for test cancellations due to reasons within the learner driver's or their instructor's responsibilities, including those mentioned above.
According to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your purchase and request a full refund within 14 days of purchase, provided the service has not yet begun. The service commences as soon as we initiate the search for practical tests on your behalf, typically shortly after payment and preference input.
We will maintain records of service usage, including your personal information provided during service acquisition, search times, and the dates and times of findings.
Each account purchased from us can only be used to search for practical driving tests on behalf of the owner of the driving licence number entered in the driving licence number box on the account preferences form. We reserve the right to suspend accounts without a refund if we believe they are not being used in accordance with this rule. We will make reasonable efforts to contact you before suspending your account.
If you have paid via Apple then refunds are entirely at Apple's discretion. As per the terms and conditions for iTunes purchases, all purchases with Apple are final. They often make exceptions, but as a general rule, refunds are not guaranteed and we cannot intervene to guarantee it due to Apple's terms.
